These Lay-by terms and conditions relate to Radian Stores Retail Limited’s IN-STORE Lay-by service. Lay-by services are currently unavailable on our online store.
Please do not proceed with the use of Radian Stores Retail Limited’s Lay-by service unless you have read, understood, and agree to the below terms and conditions.
What is Radian Lay-By?
“Radian Lay-By” means a facility in your name, whereby we reserve goods that you have chosen and which you pay form in instalments over a given period of time while we hold such goods.
How will Radian Lay-By Work?
Once you have decided to utilize the Radian Lay-By service, express your intent to the shop manager. The manager will then take down details of your product choice and thereafter guide you on details required from you for you to enjoy the lay-by Facility. You will then be requested to make your initial deposit which can be made using cash, debit card or mobile money. Upon receiving the initial deposit, you will be issued with a Radian Lay-By/ Gift Card and a Deposit Receipt indicating the amount of your deposit.
Present the card for every other subsequent instalment that you make and ensure that you collect a Deposit Receipt for each deposit that you make. Once you have deposited sufficient money equivalent to the price of the selected item, the item will accordingly be invoiced and thereafter be released to you. Ensure that you collect the Tax Invoice of your purchased item.
Is there any start-up registration fee? How much will I have to deposit as my first instalment?
Is there any start-up registration fee? How much will I have to deposit as my first instalment? Yes, the lay-by card and service has a nominal fee of K5 on start up only (non-refundable). You will be required to deposit a minimum of 10% of the price of the selected item as your initial deposit.
Do all Radian items qualify for lay-by?
All Radian items will qualify for lay-by provided the item price is equal to or above K2, 000. Note that items on promotion will only qualify for lay-by at the regular price and not the promotion price. Also note that if the product that you have initiated lay-by is later discovered to be on promotion, you will not be eligible to cancel the ongoing lay-by in order to purchase the product on the promotion price.
Is there any limit to the number of deposits that I can make?
No. You are free to make as many deposits as you like. However, you will be expected to conclude your instalments within 90 days from the date of your first instalment. If 90 days elapse without full settlement of your lay-by, we may, at our discretion, grant you a grace period within which time allow you to conclude your lay-by or opt to cancel the lay-by altogether based on our cancellation terms on page 3.
Can I cancel my lay-by?
Yes. You can cancel the lay-by within the standard period of the lay-by which is 90 days from the date of first deposit, but it will attract a service charge of 2.5% of the paid-up amount. Also, if you request for the cancellation of the lay-by after the standard period of 90 days, the surcharge will be as below:-
- Up to 30 days beyond the standard period of lay-by will attract a penalty of 10% of the paid-up amount.
- 31 days up to 90 days beyond the standard period of lay-by will attract a penalty of 25% of the paid-up amount.
- 91 days beyond the standard period of lay-by will attract a penalty of 40% of the paid up amount. However, if we realize that you are inclined towards constantly cancelling your lay-by plans without valid reasons, then you will no longer be eligible to enjoy the Radian Lay-by / Gift Card service.
What happens if the price of my intended item goes up while my lay-by is active?
Radian will offer you price guarantee (Price Lock) on the original price of the product that you wish to utilize our lay-by service on for a period of 3 months only.
The above is subject to the following conditions:
- Price changes are inevitable due to the inflation and exchange rate fluctuations. If the price of your layby item is found to have been revised upwards by 10% and above at the time of completion of your lay-by, you will be required to top up the, difference between the original price you started the lay-by at, and the new price.
- If the price of your lay-by item is found to have been revised upwards but below the 10% mark at the time of completion of your lay-by, you will pay the original price you started your lay-by at, and not the new price.
- In the event that the price of the product placed on layby is revised downwards at the point of completion, Radian will offer you the product at the prevailing price.
Will my intended lay-by item be reserved for me?
Radian will attempt to reserve your intended lay-by item for the stipulated 90 days limit. If the 90 days limit exceeds, then Radian cannot guarantee availability of stock. If you exceed the limit, and find that the stock is no longer available, then you will be given the option of refund and purchase another product with a similar value.
Will I be penalized for exceeding payment/s period?
Failure to conclude all the payments within the standard period of the lay-by which is 90 days will attract a penalty as below:-
- Up to 30 days beyond the standard period of lay-by will attract a penalty of 10% of the paid-up amount.
- 31 days up to 90 days beyond the standard period of lay-by will attract a penalty of 25% of the paid-up amount.
- 91 days beyond the standard period of lay-by will attract a penalty of 40% of the paid-up amount.
If you have not breached any terms related to the lay-by facility, and for reasons beyond our reasonable control, we are unable to deliver that Type to you, we will, at your option:-
Supply you with an equivalent quantity of goods that are comparable or superior in description, design or quality; or Refund to you the full amount deposited with us for the goods. You understand and agree that the goods will not be handed over to you and you will not become the owner thereof until you have paid the full purchase price for the goods. The goods will remain at our risk until you have accepted delivery of them. Once the final deposit is done and a Tax Invoice is issued to you, you will become the owner thereof and the goods will have to be collected by you.
If after issuance of the Tax Invoice the goods are left uncollected in the branch, then a grace period of 7 Days will be granted from the Tax Invoice issuance date in which to collect the said goods. Once 7 Days have elapsed, you will be charged a Storage Rental fee of K5.00 for each passing day for the safe keeping of your uncollected goods. Information collected from this transaction will be used for the purpose of processing your lay-by and may also be provided to third parties, to send reminders via letter, phone call, SMS, email or social media.
Information collected from this transaction will also be used for the purposes of contacting you regarding any change in Radian policies and procedures that may affect you. The Lay-by / Gift Card will always remain property of Radian and, without our losing any right to any claim which we have against you, we have the right, at any time, to cancel, suspend, repeal or demand the return of your Card.
The Radian Lay-By / Gift Card service is an interest free arrangement. No interest will be paid on deposits made under any circumstances. You understand and confirm that in the case of your death, Radian shall have the right to release the money lying to the credit of your Lay-by Account to the nominee appointed by you as your next of kin or person appointed as your estate administrator who shall be given the said funds.
Radian may retain any and all funds in the Account of the Customer until it establishes the identity and credentials of the successor(s) at its sole satisfaction, and Radian reserves the right to demand and inspect requisite documentation in this regard, including an administrator-general’s letter/probate of a will.
By entering into a lay-by transaction with Radian, you acknowledge to have read and understood these terms and conditions and accept to be bound by them. You are responsible to look after your Card, to keep it safe and the proper use of it as, if stolen, it may still be used to make purchases. You must also not allow anyone else to use your card.
Lost or Stolen Cards will not be refunded.
However, should you be in possession of the deposit receipts issued when adding money to the card, you can call the Radian Lay-By Hotline on 0955-723426 to report it lost or stolen, we will then block the remaining amount on the card and transfer it to another Lay-By card, made available when you next visit a Radian store or when notified by the manager. Note also that a replacement Lay-By / Gift Card will require a police report and a photocopy of the NRC with a K10.00 card replacement fee.
You will not be liable for use of the Card after you have notified us and we have stopped future transactions on the Card, unless – Your signature appears on the voucher, sales slip, or similar record evidencing that particular use of the Card; or We have other evidence sufficient to establish that you authorised or were responsible for the use of the Card.
Lay-By / Gift Card balances can be checked as follows:
In-store at a till point; or by calling the Radian Lay-By Hotline 0955-723426/0953-749530. No Lay-By transaction shall be carried out when the branch is experiencing technical difficulties. No customer will be allowed to leave money at the branch during such a period and if they decide to do so, shall be at their own risk. Therefore rendering Radian liability inapplicable.
The Lay-By / Gift Card is reusable. The Lay-By / Gift Card can be loaded and reloaded with any value between K100.00 and K15, 000.00 once the initial 10% deposit of the price of the intended item has been done. The Lay-by / Gift Card can only be used for one(1) product only, if and where such gift card has been topped-up, then it will remain valid from activation date.
Photographic proof of identity must be presented when creating a Lay-by, collecting the goods or terminating the Lay-by. Payments can only be made in person at the store of purchase. You are entitled to take delivery of any of the goods until all instalments have been paid. Conclusion and collection of lay-by goods may only be done by the purchaser.
If you would like somebody else to conclude & collect your layby on your behalf please provide them with a signed letter of permission and a copy of your ID as well as the Lay-by / Gift Card. You understand and agree that the lay-by goods are identified and described by style, make, model, kind, design or category (“Type”). This does not mean that specific goods are set aside for the duration of the lay-by agreement, but that we will deliver that Type to you after receipt of the full purchase price.
